Conditions of Room Hire


Welcome to D R DOWNES & ASSOCIATES – Practice Privileges. Due to the nature of the work that will take place in our consulting room’s, conditions of our room hire are set out below.

Prior to any professional using any one of our consulting rooms, it’s essential our conditions of practice privileges are read carefully and acknowledged.  This is in addition to submitting the relevant documentation listed in the compliance checklist.

Definitions

In this Terms of Service, the following words have the following meanings:

Customer includes the following: customers who have entered into a contract with us for the supply of the Services at D R DOWNES & ASSOCIATES in accordance with our Terms of Service and Data Protection Policy for Associates.

Associate means associate who is hiring our consulting rooms and is not an employee of the Company, howsoever.

UsOurWe or Company means D R DOWNES & ASSOCIATES and our Staff.

YouYourTheir,or Customer means you the customer

Staff means our employees, workers, agents and sub-contractors of the Company

Consulting Rooms means:

  • Suite 37, Red Hill House, Hope Street, Hough Green, Chester, CH4 8BU
  • Suite 14, Station House, Central Way, Warrington, WA2 7TT
  • 2nd Floor, Milton Hall, 244 Deansgate, Manchester, M3 4Q

1. CONDITIONS OF PRACTICE PRIVILEGES 

BASED ON ADHOC ROOM HIRE

  • The Associate fully accepts responsibility for their own Insurance and agrees that the Company shall not be responsible for any treatments or appointments made between the Associate and their clients.
  • It is essential the Associate belongs to a professional body at all times, and possess the relevant qualifications required by their body to practice the therapies they intend to practice in the Room. The Company will require a copy of all necessary validating documents.
  • The Company will not take bookings from another person on behalf of the Associate. The Associate agrees that they are operating independently when using the Room, maintaining their own control over their bookings, finances and development of their own practice.
  • The Associate is responsible for their Tax and National Insurance, and is not an employee of the Company, howsoever.
  • The Associate is not an officer of the Company and cannot enter into any financial agreement or binding commitment on-behalf-of the Company.
  • The Company will not accept any payment transactions for therapy fees on behalf of the Associate.
  • The Associate agrees that this agreement is exclusively for the purpose of performing legal psychological therapies and supervision in the Room.
  • The Associate agrees not to remove or install any item of furniture, fittings or materials in the Room, without prior written agreement from the Company.

2. USE OF THE CONSULTING ROOMS 

  • The Consulting Rooms must only be used during the hours that have been agreed and booked.
  • The Associate accepts full responsibility for their own conduct and that of their Clients when in the business centre and the consulting rooms.
  • The Associate agrees to be considerate and courteous at all times in dealing with other members of staff and tenants within the business centre and local residents.
  • The Associate agrees to ensure that the consulting rooms are left in a clean, tidy condition and ready for use by another Associate. If any incidents or problems occur that require attention, these must be reported to David or Rebecca Downes immediately.
  • The moderate use of stereos for sound is welcome, but the level of the sound must be respectful to the other users within the business centre.

3. CONSULTING ROOMS HIRE FEE AND PAYMENT TERMS

  • The Room hire fee shall be payable by the Associate to the Company, payable in advance by Bank Transfer.
  • Failure to make payments as agreed may result in the Company refusing to accept further bookings and cancel Practice Privileges.
  • In no event will the Company be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of privileges or profits, arising out of or in connection with the use of our room.

4. CANCELLATION 

  • The Company reserves the right to cancel bookings.  If it is unable to provide access to the consulting rooms due to any so called “force majeure” events beyond its control.  This may include but not limited to; flood, fire, and breakdown of heating, power failure or any other events beyond its control.
